Jessica Ross and Trevon Isaiah Taylor Sr. have filed a lawsuit against Dr. Jackson Gates, whom they hired to do an autopsy on their infant on July 12, according to people.com.
The suit alleges fraud, a violation of the couple’s privacy and “intentional infliction of emotional distress,” and they are seeking $10,000 in punitive damages.
Earlier, the couple filed another lawsuit claiming “gross negligence” by the delivery doctor Dr. Tracey St. Julian, the nurses and the facility where the birth took place.
In that earlier suit, they claimed their child was “decapitated” during birth, and that Julian delivered “only the legs and the body” by cesarean section while his head was delivered vaginally.
The couple allege Julian didn’t clarify that the child had been decapitated.

While working with Gates on the autopsy, they allege he shared a video of the “postmortem examination of the decapitated, severed head” of the baby on his Instagram account with about 11,500 followers on July 14.
“This video showed in graphic and grisly detail a postmortem examination of the decapitated, severed head of Baby Isaiah,” the lawsuit claims.
That first video, the suit alleges, was removed by Gates but he uploaded two more videos from the postmortem on July 21.
The parents say in the suit that they were left with “feelings of shock, anger, humiliation and outrage and they never gave Gates permission to record the process of share the video on social media.”
“This is one of the most egregious and outrageous cases of ‘clout chasing’ we have ever encountered,” the couple’s lawyer said in a statement to the Miami Herald.
Dr. Gates did not respond to repeated requests for comments from PEOPLE.
